Certificaciones de Save The Bees USA

Estos Términos y Condiciones de Certificación rigen la participación en todos los programas de certificación administrados por Save The Bees USA, una corporación sin fines de lucro de Texas reconocida como exenta de impuestos bajo la Sección 501(c)(3) del Código de Rentas Internas.
Al enviar una solicitud, pagar la tarifa de certificación aplicable, aceptar la certificación o utilizar cualquier nombre, certificado, insignia, parche, logotipo o material relacionado con la certificación de Save The Bees USA, el solicitante acepta estos términos.
1. Propósito de la certificación
Las designaciones de certificación de Save The Bees USA reconocen a las personas que cumplen con los estándares publicados para la certificación seleccionada y demuestran un compromiso con la gestión de polinizadores, la educación, la conservación, las prácticas responsables y el servicio comunitario.
La certificación significa que Save The Bees USA ha determinado que la persona cumplió con los requisitos de certificación vigentes en el momento en que se aprobó la solicitud.
La certificación no constituye:
- Una licencia emitida por el gobierno
- Una licencia profesional u ocupacional
- Una garantía de competencia, seguridad, rendimiento o resultados
- Un respaldo de cada producto, servicio, negocio, opinión o actividad asociada con la persona certificada
- Empleo en Save The Bees USA
- Autorización para actuar como agente o representante legal de Save The Bees USA
- Permiso para celebrar acuerdos en nombre de Save The Bees USA
2. Requisitos de elegibilidad
Los solicitantes deben:
Tener al menos 18 años.
Cumpla con los requisitos de experiencia, educación, capacitación, actividad, propiedad u otros requisitos de elegibilidad publicados para la certificación seleccionada.
Envíe una solicitud de certificación completa y precisa.
Proporcione la documentación, fotografías, registros u otras pruebas solicitadas que respalden su elegibilidad.
Comprometerse a seguir prácticas responsables, éticas, seguras y de apoyo a los polinizadores aplicables a la certificación seleccionada.
Cumpla con todas las leyes, ordenanzas, permisos, registros, regulaciones y requisitos de zonificación federales, estatales y locales aplicables.
Save The Bees USA puede solicitar documentación adicional, referencias, aclaraciones o una entrevista antes de tomar una decisión de certificación.
3. Revisión y aprobación de solicitudes
La presentación de una solicitud no garantiza la certificación.
Save The Bees USA puede aprobar, negar, diferir o solicitar información adicional con respecto a cualquier solicitud. Las decisiones de certificación son tomadas por Save The Bees USA basándose en los estándares del programa vigentes en el momento de la revisión.
Save The Bees USA no está obligado a divulgar notas de revisión confidenciales, deliberaciones internas, procedimientos de evaluación patentados o información proporcionada por terceros.
Un postulante que actualmente no cumpla con los requisitos del programa puede ser invitado a postularse nuevamente después de adquirir capacitación o experiencia adicional.
4. Exactitud de la información de la solicitud
El solicitante certifica que toda la información, declaraciones, credenciales y documentos presentados son precisos, actuales, completos, auténticos y no engañosos.
Proporcionar información falsa, alterada, incompleta, fraudulenta o engañosa puede resultar en:
- Denegación de la solicitud
- Suspensión o revocación inmediata de la certificación
- Eliminación de los directorios y programas de Save The Bees USA
- Pérdida de tarifas de certificación
- Prohibición de volver a postularse
- Remisión a una autoridad competente cuando lo exija la ley
Los solicitantes deben notificar a Save The Bees USA sin demora si la información material presentada en la solicitud cambia.
5. Tarifa de certificación y política de reembolso
La cuota anual de cada certificación de Save The Bees USA es de $99, a menos que se indique un monto diferente en la página correspondiente de solicitud o renovación al momento del pago.
La tarifa de certificación cubre la revisión de solicitudes, la verificación de credenciales, la administración del programa, los registros de certificación, los materiales de certificación y las operaciones anuales del programa.
El pago de la tarifa de certificación no garantiza la aprobación.
Reembolso si la certificación no es aprobada
Si un solicitante no es aprobado para la certificación, Save The Bees USA le reembolsará la tarifa de certificación pagada por el solicitante.
El reembolso se emitirá al método de pago original, generalmente dentro de los 10 días hábiles posteriores a la notificación al solicitante de que la solicitud no fue aprobada.
No se le exigirá al solicitante que solicite el reembolso por separado.
Solicitudes incompletas
Si una solicitud no puede ser evaluada debido a que falta información o documentación requerida, Save The Bees USA notificará al solicitante y le proporcionará una oportunidad razonable para completar la solicitud.
Si el solicitante no proporciona la información solicitada dentro del plazo establecido y la solicitud se cierra sin aprobación, se reembolsará la tarifa de certificación.
Retiro del postulante
Si un solicitante retira voluntariamente la solicitud antes de que se apruebe la certificación, se reembolsará la tarifa de certificación.
Pagos fraudulentos o disputados
Save The Bees USA puede retener o retrasar un reembolso cuando sea razonablemente necesario para investigar un fraude sospechoso, un pago no autorizado, una disputa de pago, un contracargo o información de solicitud materialmente falsa.
Cualquier reembolso estará sujeto a las reglas y plazos de procesamiento del procesador de pagos y la institución financiera correspondientes.
Certificaciones aprobadas
Una vez que se haya aprobado una solicitud y se haya emitido o preparado el certificado, la insignia digital, el parche u otros materiales de certificación, la tarifa de certificación no es reembolsable, excepto cuando la ley lo exija o Save The Bees USA lo apruebe expresamente.
6. Periodo de certificación
La certificación es válida por un año a partir de la fecha de aprobación, a menos que aparezca una fecha de vencimiento diferente en el certificado o en el registro de certificación.
La persona certificada puede presentarse como titular de la certificación Save The Bees USA seleccionada únicamente mientras dicha certificación permanezca activa y en regla.
La certificación vence automáticamente si no se renueva antes de la fecha de expiración.
7. Renovación anual
Para mantener la certificación activa, la persona certificada debe:
- Envíe la información de renovación requerida
- Confirmar el cumplimiento continuo de las normas del programa
- Actualizar información de contacto, capacitación, experiencia, seguro o información profesional desactualizada
- Divulgue cualquier problema material legal, reglamentario, de seguridad o profesional
- Pague la tarifa de renovación anual aplicable
- Completa cualquier requisito de educación continua adoptado por Save The Bees USA
Después de cada renovación anual exitosa, y después de cualquier confirmación requerida de elegibilidad continua, Save The Bees USA emitirá un nuevo parche bordado que mostrará el año de certificación correspondiente. La persona certificada es responsable de mantener una dirección postal actualizada. Los parches de reemplazo y los parches devueltos debido a una dirección incorrecta pueden estar sujetos a una tarifa adicional.
Save The Bees USA puede revisar los requisitos de renovación a medida que el programa se desarrolle.
La renovación no está garantizada. Save The Bees USA puede negarse a renovar una certificación cuando la persona ya no cumpla con los requisitos del programa o haya violado estos términos.
8. Renovación automática
La certificación no se renovará automáticamente a menos que el solicitante seleccione y autorice afirmativamente una opción de renovación automática.
Cuando se selecciona la renovación automática, el solicitante autoriza a Save The Bees USA y a su procesador de pagos a realizar el cargo de la tarifa de certificación anual correspondiente utilizando el método de pago registrado.
La persona certificada puede cancelar la renovación automática antes del cargo de renovación a través del método proporcionado por Save The Bees USA.
La cancelación de la renovación automática no cancela inmediatamente una certificación activa. La certificación sigue siendo válida hasta su fecha de expiración indicada, a menos que sea suspendida o revocada. Se emite un nuevo parche anual únicamente después de que se procese con éxito un pago de renovación y se complete cualquier confirmación de elegibilidad continua requerida.
9. Beneficios de la certificación
Una persona certificada y aprobada puede recibir beneficios que incluyen:
- Un certificado que identifica la certificación aprobada de Save The Bees USA
- Un nuevo parche de certificación bordado que muestra el año de certificación correspondiente después de la aprobación inicial y cada renovación anual exitosa
- Permiso para usar gráficos de certificación aprobados
- Elegibilidad para su inclusión en un directorio de certificación pública
- Acceso a recursos relacionados con la certificación
- Consideración de oportunidades educativas, de tutoría, de conservación, comunitarias, escolares, de voluntariado o remuneradas, cuando corresponda
- Actualizaciones del programa y avisos de renovación
Los beneficios pueden cambiar y no se garantiza que sigan estando disponibles de la misma forma cada año.
La certificación no garantiza empleo, compensación, clientes, oportunidades para hablar en público, referencias, contratos, subsidios, asignaciones ni participación en los programas de Save The Bees USA.
10. Uso del nombre y de los materiales de la certificación
Mientras la certificación esté activa y vigente, la persona certificada recibe una licencia limitada, revocable, no exclusiva e intransferible para identificarse como:
- El título exacto de la certificación Save The Bees USA que se muestra en su certificado activo
El nombre de la certificación, el certificado, la insignia, el parche, el logotipo, los gráficos y los materiales relacionados siguen siendo propiedad de Save The Bees USA.
Las personas certificadas pueden utilizar los materiales de certificación aprobados únicamente de acuerdo con las instrucciones y normas de marca proporcionadas por Save The Bees USA.
Las personas certificadas no pueden:
- Alterar, redibujar, distorsionar, recolorear, recortar o modificar la insignia o logotipo de certificación
- Transferir, vender, sublicenciar, copiar, reproducir o permitir que otra persona utilice su certificación
- Permitir que una empresa, organización, empleado, socio o miembro de la familia reclame la certificación basándose en la aprobación del individuo
Representar que un producto, miel, apiario, jardín, hábitat, empresa, servicio, curso, evento, organización o propiedad cuenta con certificación independiente, a menos que Save The Bees USA proporcione autorización por escrito
- Save The Bees USA garantiza y respalda este producto.
- Utilizar los materiales de certificación de manera engañosa, falsa, ilegal, difamatoria o despectiva
- Continuar usando los materiales de certificación después de su expiración, suspensión, revocación o retiro voluntario
Save The Bees USA may issue separate certification-branding guidelines. Those guidelines become part of these terms.
11. Public Certification Directory
Save The Bees USA may offer certified individuals the opportunity to appear in a public directory.
Directory information may include:
- Nombre
- City and state
- Certification status
- Certification year
- Areas of interest
- Skills, specialties, services, or areas of focus
- Teaching, speaking, volunteer, or program availability
- Business or organization name
- Website or professional contact information
Save The Bees USA will publish only the information authorized for public display.
Participation in the public directory may be optional. Save The Bees USA may remove or correct directory listings at any time.
Sensitive application documents, identification records, payment information, and private training documentation will not intentionally be displayed in the public directory.
12. Standards of Conduct
Save The Bees USA certified individuals are expected to:
- Follow the standards, practices, and commitments applicable to the selected certification
- Use responsible safety, stewardship, maintenance, and risk-management practices appropriate to their activities
- Protect public safety when conducting, demonstrating, teaching, promoting, or providing any activity connected with the certification
- Communicate honestly about their qualifications, training, experience, activities, products, and services
- Follow applicable labeling, consumer-protection, environmental, agricultural, food-safety, and professional requirements
- Treat students, educators, customers, volunteers, property owners, and members of the public professionally and respectfully
- Avoid discrimination, harassment, exploitation, intimidation, and abusive conduct
- Protect confidential and personal information received through program activities
- Avoid making false, deceptive, or unsupported claims
- Avoid conduct that could reasonably damage the reputation, credibility, or mission of Save The Bees USA
- Follow all additional safety requirements established for school, youth, and community programs
13. School, Youth, and Community Programs
Certification alone does not authorize an individual to participate in school, youth, community, observation-hive, gardening, mentoring, advocacy, or educational programs on behalf of Save The Bees USA.
Save The Bees USA may separately evaluate certified individuals for these opportunities.
Additional requirements may include:
- A background check
- References
- An interview
- Proof of insurance
- Presentation review
- Safety training
- Youth-protection requirements
- School-district requirements
- Venue requirements
- A volunteer agreement
- An independent-contractor agreement
- A separate program agreement
A certified individual may not represent that they have been approved for a specific Save The Bees USA program unless written approval has been issued for that program.
14. Independent Status
Certification does not create an employment, agency, partnership, franchise, joint venture, fiduciary, or representative relationship between Save The Bees USA and the certified individual.
Certified individuals operate independently and remain responsible for their own:
- Decisions
- Conduct
- Certification-related and independent activities
- Equipment
- Plants, gardens, habitats, colonies, animals, or other property under their care
- Vehicles
- Property
- Employees
- Contractors
- Products
- Servicios
- Customers
- Taxes
- Insurance
- Licenses
- Permits
- Business obligations
No certified individual may sign contracts, make financial commitments, accept donations, issue statements, or incur obligations on behalf of Save The Bees USA without prior written authorization.
15. Insurance and Legal Compliance
Certified individuals are solely responsible for determining and maintaining the insurance appropriate for their activities.
Depending on their activities, appropriate coverage may include:
- General liability insurance
- Product liability insurance
- Commercial automobile insurance
- Property insurance
- Workers’ compensation insurance
- Professional or educator liability coverage
- Event coverage
Save The Bees USA certification does not provide insurance or legal protection to the certified individual.
Certified individuals are responsible for obtaining all permits, registrations, inspections, licenses, approvals, and insurance required for their activities.
16. Complaints and Investigations
Save The Bees USA may review complaints or information concerning a certified individual’s:
- Conduct
- Qualifications
- Credentials
- Public representations
- Safety practices
- Legal compliance
- Business practices
- Use of certification materials
- Participation in Save The Bees USA programs
Save The Bees USA may request an explanation, documents, references, or other information from the certified individual.
Failure to provide requested information within the stated period may result in suspension, revocation, nonrenewal, or removal from program opportunities.
Save The Bees USA may temporarily suspend certification while a serious complaint or safety issue is investigated.
Save The Bees USA may maintain the confidentiality of complainants, witnesses, students, schools, and internal review materials when reasonably necessary.
17. Suspension, Revocation, and Nonrenewal
Save The Bees USA may suspend, revoke, or decline to renew certification for reasons including:
- False, altered, fraudulent, or misleading application information
- Failure to maintain eligibility
- Misuse of the certification name, badge, certificate, patch, or logo
- Unsafe, unlawful, unethical, or seriously unprofessional conduct
- Material violation of these terms
- Conduct that threatens students, schools, customers, members of the public, pollinators, animals, or property
- Serious or repeated complaints
- Fraudulent or deceptive business practices
- Failure to comply with applicable laws or regulations
- Conduct that materially harms the reputation or mission of Save The Bees USA
- Failure to cooperate with a reasonable review or investigation
- Nonpayment, disputed payment, chargeback, or reversal of required fees
Save The Bees USA may determine the effective date and duration of a suspension.
Certification fees are not automatically refundable following suspension, revocation, expiration, or nonrenewal.
18. Responsibilities Following Expiration, Suspension, or Revocation
When certification expires, is suspended, or is revoked, the individual must immediately:
- Stop representing themselves as currently certified
Remove certification claims from websites, social media, advertisements, business cards, email signatures, signs, vehicles, printed materials, and online listings
- Stop using the certification badge, logo, or related graphics
- Stop presenting expired or revoked certification materials as evidence of current certification
- Comply with any additional written instructions issued by Save The Bees USA
Physical patches and certificates may be retained as personal records but may not be displayed or used in a manner that suggests the certification remains active.
19. Voluntary Withdrawal
A certified individual may voluntarily withdraw from the program by providing written notice to Save The Bees USA.
Voluntary withdrawal ends authorization to use the certification name and materials.
Certification fees are not refundable because an individual voluntarily withdraws.
20. No Guarantee or Warranty
Save The Bees USA does not guarantee:
- The quality or outcome of any individual’s certification-related activities
- The survival, health, condition, or performance of pollinators, plants, gardens, habitats, colonies, or property
- Production, sales, services, advocacy, education, or outreach results
- Pollination, habitat, conservation, or environmental results
- Business success
- Customer satisfaction
- Regulatory approval
- Public acceptance of the certification
- Availability of teaching, mentoring, referral, volunteer, or paid opportunities
- Continued availability of the certification program
- Continued availability of any specific certification benefit
The certification program and certification materials are provided on an “as available” basis to the fullest extent permitted by law.
21. Limitation of Responsibility
Certified individuals act independently and remain solely responsible for their own actions, omissions, representations, equipment, plants, gardens, habitats, colonies, property, products, services, and interactions with third parties.
To the fullest extent permitted by law, Save The Bees USA is not responsible for injuries, losses, claims, damages, allergic reactions, insect stings, plant or colony losses, property damage, regulatory violations, business losses, customer disputes, vehicle accidents, or other incidents arising from the independent activities of an applicant or certified individual.
Nothing in these terms excludes responsibility that cannot legally be excluded.
22. Indemnification
To the extent permitted by law, the applicant or certified individual agrees to defend, indemnify, and hold harmless Save The Bees USA and its directors, officers, employees, volunteers, contractors, representatives, and affiliates from claims, liabilities, damages, losses, judgments, penalties, costs, and reasonable expenses arising from:
- The individual’s certification-related or independent activities
- Products or services provided by the individual
- Participation in events or educational activities
- Misuse of certification materials
- Violation of these terms
- Violation of law
- Negligent, reckless, fraudulent, or intentional conduct
- Claims made by customers, students, schools, property owners, employees, contractors, or other third parties
This provision does not apply to liability that cannot legally be waived, excluded, or transferred.
23. Privacy and Records
Application information will be handled according to the Save The Bees USA Privacy Policy.
Applicants authorize Save The Bees USA to:
- Review submitted credentials and documentation
- Verify training and experience
- Contact references or training providers when reasonably necessary
- Maintain certification and compliance records
- Communicate regarding application, certification, renewal, and program matters
- Publish authorized directory information
Applicants should not upload Social Security numbers, financial account numbers, medical records, or other unnecessary sensitive information.
24. Electronic Communications
The applicant consents to receive application, payment, certification, renewal, compliance, and program communications electronically.
The applicant is responsible for maintaining a current email address and contact information.
Electronic notices sent to the most recent email address provided by the applicant will be considered delivered even when the applicant fails to review them.
25. Program and Terms Changes
Save The Bees USA may revise:
- Eligibility requirements
- Certification standards
- Fees
- Benefits
- Renewal requirements
- Continuing-education requirements
- Branding guidelines
- Program procedures
- These Certification Terms and Conditions
Material changes will be communicated through the Save The Bees USA website, renewal materials, account notices, or the certified individual’s email address.
Changes will generally apply prospectively. Continued participation in the program after revised terms become effective constitutes acceptance of those terms.
26. Governing Law and Venue
These terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.
Any legal proceeding relating to the certification program shall be brought in a court of competent jurisdiction in the Texas county where Save The Bees USA maintains its principal office, unless applicable law requires otherwise.
27. Severability
If any provision of these terms is found invalid or unenforceable, that provision will be limited or removed only to the extent necessary.
The remaining provisions will continue in full force and effect.
28. No Waiver
Failure by Save The Bees USA to enforce any provision of these terms does not waive the organization’s right to enforce that provision later.
A waiver is effective only when provided in writing by an authorized representative of Save The Bees USA.
29. Entire Agreement
These terms, together with the certification application, Privacy Policy, branding guidelines, and any separately signed program agreement, constitute the agreement governing participation in the applicable Save The Bees USA certification program.
When a separate written agreement applies to a specific teaching, contracting, volunteer, or program opportunity, that agreement will govern the specific activity.
Applicant Agreement
By checking the required agreement box and submitting the application, I confirm that:
I have read and agree to the Save The Bees USA Certification Terms and Conditions and the published requirements for the certification I selected.
I have reviewed and agree to the Save The Bees USA Privacy Policy.
The information and documentation submitted with my application are accurate, authentic, current, and complete.
I understand that payment does not guarantee approval.
I understand that certification is not a government-issued or professional license.
I understand that certification does not make me an employee, agent, partner, or legal representative of Save The Bees USA.
I understand that certification does not guarantee teaching assignments, referrals, customers, contracts, compensation, or participation in Save The Bees USA programs.
I agree to comply with certification standards and applicable laws.
I agree to stop using the certification name and materials if my certification expires, is suspended, is revoked, or is voluntarily withdrawn.
